These terms apply when you use the GameShelfClub website, including the blog, the shop finder, price information and the early access signup. Please read them. By using the site you agree to them. If you don't agree, please don't use the site.
1. Who we are
GameShelfClub is run by Awen Software Ltd (company number 17153930), whose registered office is at Unit 13 The Timber Yard, East Moors Road, Cardiff, Wales, CF24 5EE. In these terms, "we", "us" and "our" mean Awen Software Ltd, and "you" means anyone using the site. You can contact us at info@awensoftware.co.uk.
2. What GameShelfClub is
GameShelfClub is being built as a place to track prices on physical video games and trade them with other collectors. At the moment the site offers information (a blog, shop listings and examples of the features we're building) and an early access waiting list. Some features shown on the site are previews of what we plan to build and are not available yet.
The site is free to use. We may change, pause or stop any part of it, including early access, at any time, and we can't promise that any planned feature will launch.
3. Who can use the site
Anyone can read the site. To join the early access list or send us a suggestion, you must be at least 13 years old. If you're under 18, please check with a parent or guardian first.
4. Early access signup
When you join the early access list, you agree to give us a real email address that you're allowed to use. We'll use it to tell you when early access opens and to send occasional updates about GameShelfClub. Every email we send will let you unsubscribe, and you can ask us to delete your address at any time. Joining the list doesn't create an account and doesn't guarantee a place in early access. How we handle your data is explained in our privacy policy.
5. Suggestions you send us
You can suggest retailers and shops for us to add. Please only send accurate information about real businesses, and don't include personal information about anyone, including yourself. By sending a suggestion, you allow us to use, edit and publish it (for example, adding a shop to the finder) without paying you or naming you. We may decide not to use a suggestion, and we may remove anything that breaks these terms.
6. Acceptable use
When using the site, you must not:
- break any law, or use the site for anything fraudulent or harmful;
- send spam, fake signups, or content that is offensive, abusive, defamatory or infringes anyone's rights;
- try to get unauthorised access to the site, its servers or its data, or interfere with how it works (including attacks, malware and overloading it);
- use bots, scrapers or other automated tools to submit forms, or to copy the site or its data in bulk, except search engines following our robots.txt;
- try to get around our security, spam protection or rate limits;
- pretend to be someone else, or suggest that you are connected with us when you aren't.
We may block access, delete submissions or take other reasonable steps if we believe these terms have been broken.
7. Prices, shop listings and other information
Prices, discounts, shop listings, opening details and other information on the site are for general information only. They can be incomplete, out of date or wrong, for example because a shop has closed or moved, or a retailer has changed a price. Always check with the shop or retailer before you travel or buy. Prices shown on the site, including the examples in our feature previews, are not offers to sell and are not a promise of what you'll pay.
Shop listings use data from OpenStreetMap contributors, available under the Open Database Licence. Postcode lookups use postcodes.io.
Nothing on the site is financial or investment advice. Collectible games can go up or down in value, and you should make your own decisions about buying, selling and trading.
8. Other websites and shops
The site links to other websites, including retailers, shops, news sites and Reddit. We don't control them and aren't responsible for their content, products, prices, services or privacy practices. A link isn't an endorsement. Any purchase you make from a retailer or shop is between you and them.
9. Trading between collectors
Trading is a feature we're building and isn't available yet. When it launches, it will come with its own terms covering trades, safety and disputes, and you'll need to accept them before trading.
10. Blog content and sources
Our blog posts discuss news and public conversations about games, such as Reddit threads and news articles. Each post links to its sources. Quotes and images from those sources are used for the purposes of news reporting, criticism and review, are credited, and remain the property of their owners. Opinions quoted from other people are theirs, not ours. If you're the owner of something we've used and want it changed or removed, see section 13.
11. Trademarks and no affiliation
GameShelfClub is independent. We are not affiliated with, endorsed by or sponsored by any console maker, game publisher, developer or retailer mentioned on the site, including Sony Interactive Entertainment (PlayStation), Nintendo, Microsoft (Xbox), Sega, Atari, Valve or any of the retailers shown.
Names of games, consoles, companies and retailers, and retailer logos, are trademarks of their owners. We use them only to identify the products and shops we talk about and track prices for. The pixel art on the site is our own original artwork. Where it nods to well-known games, consoles or products, it is a homage, and doesn't mean any connection with, or approval by, their owners.
12. Our content
Apart from third-party material described in sections 7, 10 and 11, the site's content, including its design, text, pixel art, code and the GameShelfClub name, belongs to us or our licensors. You may view it, share links to it and print or save pages for your own personal, non-commercial use. You must not copy, republish or sell our content, or use the GameShelfClub name, without our written permission.
13. Takedown requests and complaints
If you believe something on the site infringes your copyright, trademark or other rights, is inaccurate, or is otherwise unlawful, email us at info@awensoftware.co.uk with:
- the page address and the specific content concerned;
- why you believe it should be changed or removed, and, for rights claims, what you own;
- your name and how to contact you.
We'll review every request promptly and, where appropriate, remove or correct the content. The same address works for any other complaint or question about the site.
14. Availability and security
We work to keep the site available and secure, but we can't guarantee that it will always be available, uninterrupted or free from errors or viruses. We may suspend the site for maintenance or for reasons outside our control. Use up-to-date security software on your own devices.
15. Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded by law. Nothing in these terms affects your legal rights as a consumer.
Subject to that, the site is provided free of charge and on an "as is" basis. We aren't responsible for any loss or damage that wasn't reasonably foreseeable, for any business loss, or for losses caused by your reliance on information on the site (including prices and shop listings), third-party websites or shops, or events outside our reasonable control. To the extent the law allows, our total liability to you in connection with the site is limited to £100.
16. Changes to these terms
We may update these terms, for example when new features such as accounts and trading launch. We'll change the date at the top of this page, and for significant changes we'll tell people on the early access list. Using the site after a change means you accept the updated terms.
17. General
If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a right straight away, we can still do so later. We may transfer our rights under these terms to another organisation if GameShelfClub moves to it, and we'll tell you if that affects you. These terms, together with our privacy policy, are the whole agreement between you and us about the site. Nobody else has rights under these terms.
18. Law and courts
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you can also bring proceedings in your local courts.
